Effective Date: August 24, 2026

1. Warranty Exclusion ("As-Is" Provision)

THE SITE AND ALL ORIGINAL CONTENT, SOFTWARE, FORMS, PAYMENT PORTALS, AND OPERATIONAL INFORMATION CONTAINED THEREIN ARE PROVIDED ON AN "AS IS," "WITH ALL FAULTS," AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MILL CREEK ENCORE ALLIANCE (MCEA) DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, SYSTEM INTEGRITY, SECURITY, COMPLETENESS, TITLE, ACCURACY, AND NON-INFRINGEMENT.

2. Performance Scheduling and Production Announcement Infallibility

Theatrical productions are inherently dynamic and subject to unpredictable alterations. Rehearsal calls, open call windows, callback listings, cast rolls, crew manifests, and showtimes published on this site are subject to rapid correction, modification, or cancellation by the MCHS direction staff or MCEA board without advance warning.

MCEA assumes no liability, legal responsibility, or obligation regarding rehearsal misalignments, performance omission disappointments, lost travel expenditures, or scheduling conflicts experienced by users who rely on outdated, uncached, or unrealized web scheduling infrastructure. It remains the absolute responsibility of the student and parent to confer directly with the theater instructors to verify critical timelines.

3. Strict Limitation of Liability and Damages Exclusion

IN NO EVENT SHALL THE MILL CREEK ENCORE ALLIANCE (MCEA), ITS BOARD OF DIRECTORS, OFFICERS, REGISTERED AGENTS, FOUNDING MEMBERS, VOLUNTEERS, AS WELL AS MILL CREEK HIGH SCHOOL, THE GWINNETT COUNTY SCHOOL DISTRICT, OR GWINNETT COUNTY PUBLIC SCHOOLS, BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, STATUTORY, OR PUNITIVE DAMAGES WHATSOEVER.

4. Inherent Physical Risk and Volunteer Waiver Indemnification

The site offers users interactive access to sign up for physical labors associated with the theatric arts, including set construction, scenic painting, rigging operation, heavy prop stage management, power tool utilization, lighting tech mounting, and backstage strikes. These activities are inherently hazardous.

By utilizing the portals on this site to register individuals for these volunteer capacities, parents, guardians, and adult volunteers explicitly acknowledge and agree that they are voluntarily encountering known physical risks. To the maximum extent allowable under Georgia law, you agree to indemnify, defend, and hold completely harmless MCEA, its representatives, and extended public school component bodies from any claims, actions, cost injuries, medical expenses, or liabilities arising from injuries sustained during physical operational engagements related to the theater program.

For liability or structural inquiries concerning risk management protocols, please reach out to the board via email at hello@millcreektheatre.com.
